SipScout’s Mobile App Privacy Policy

Introduction 

SipScout Social, LLC (“Company” or “We” or “Our”) respect your privacy and are committed to protecting your privacy through our compliance with this Privacy Policy (“Policy“). The mobile application SipScout: Happy Hours & Events (the “SipScout App”) provides platform features that enable users to discover restaurants, bars, social events, and promotional offerings. These features, along with all related functionality made available through the mobile application, are collectively referred to as the “Service.” For purposes of these Terms, “Venues” refers to restaurants, bars, event spaces, and other businesses featured through the Service.  

This Policy describes:  

  • The types of information we may collect or that you may provide when you purchase, download, install, register with, access, use, or otherwise interact with the SipScout App and/or Service. 
  • Our practices for collecting, using, maintaining, protecting, and disclosing that information. 

This policy applies to information we collect in the SipScout App and in email, text, and other electronic communications sent through or in connection with the SipScout App.  

This policy DOES NOT apply to information that: 

  • We collect offline or on any other Company apps or websites, including websites you may access through the SipScout App.  

The SipScout App may contain links to third-party platforms. These third parties may have their own privacy policies, and we encourage you to review those policies before providing any information. 

Please read this policy carefully to understand our policies and practices regarding your information and how your information is used by our Company. If you do not agree with our policies and practices, do not download, register with, or use this the SipScout App. By downloading, registering with, or using this the SipScout App, you agree to this Policy. This Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the SipScout App after we revise this Policy means you accept the changes, so please review the Policy periodically for updates.  

Age Requirement & Children’s Privacy 

The SipScout App is intended for individuals who are 21 years of age or older. We do not knowingly collect personal information from individuals under 21. If we learn that we have collected or received personal information from an individual under 21 we will delete that information. How We Collect Information 

We collect information about users of our SipScout App in the following ways: 

  • Directly from you when you provide it to us. 
  • Automatically when you use the App.  

Information You Provide to Us  

When you download, register with, or use the SipScout App, we may ask you provide information: 

  • By which you may be personally identified, such as name, email address, telephone number, passwords or a unique user identifier associated with your account. We do not collect or store your password when you sign in using third-party authentication providers (such as Google or Apple), and any other identifier by which you may be contacted online or offline (“personal information“). 
  • That is about you but individually does not identify you, such as your saved Venues, preferences, notification settings, and other in-app customization choices. 

This information includes:  

  • Information that you provide by filling in forms in the App. Such as information provided at the time of registering to use the SipScout App and posting material.  
  • Information that you provide when entering a contest or promotion sponsored by us. 
  • Information that you provide when reporting a problem with the SipScout App. 
  • Information you provide when saving Venues, setting preferences, searching for venues, or interacting with listings. 
  • Venue-related information submitted by venue owners, including Venue details, happy hour schedules, menu items, event information, and photos. 
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us. 
  • Your responses to surveys that we might ask you to complete for research purposes. 
  • Your search queries on the SipScout App and other content you submit within the app.  

You may also provide information for publication or posted on public areas of the SipScout App (collectively, “User Contributions“). Your User Contributions are posted and transmitted to others at your own risk. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. 

Automatic Information Collection and Tracking    

When you download, access, and use the SipScout App, it may use technology to automatically collect: 

  • Usage Details. When you access and use the SipScout App, we may automatically collect certain details of your access to and use of the SipScout App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the SipScout App, as well as information including, but not limited to, pages visited, features used, search queries, location, and interaction patterns. 
  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, unique device identifiers, browser type, mobile network information, and the device’s telephone number. 
  • Stored Information and Files. The SipScout App also may access metadata and other information associated with other files stored on your device, such as images and video, address book contacts, or other information necessary for the use of the SipScout App and Service, or necessary for certain opt-in features and interactions. 
  • Location Information. The SipScout App may collect real-time information about the location of your device. With your permission, the SipScout App collects geographic location data to show nearby venues. 

If you do not want us to collect this information do not download the SipScout App, or delete it from your device. Note, however, that opting out of the SipScout App’s collection of location information will disable its location-based features. 

We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking).  

Information Collection Technologies  

The technologies we use for automatic information collection may include: 

  • Local data storage. Selected data may be stored locally on your device in order to facilitate your use of the SipScout App, such as retaining login session information or caching data for performance reasons. 
  • Remote data storage. We maintain aggregated and anonymized data on customer usage patterns, and retain limited non-anonymized data for operational purposes and reporting. Other than data used for operational purposes (including, but not limited to, data such as check-ins to venues, ratings and reviews, and uploaded images), we periodically purge non-anonymized data. 

Third-Party Information Collection 

When you use the SipScout App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:  

  • Authentication Providers: If you sign in using third-party authentication services such as Google or Apple, we receive basic profile information (such as your name and email address) as permitted by those providers. Your use of those services is subject to their respective privacy policies.  
  • Analytics Providers: We use third-party analytics services to help us understand how users interact with the SipScout App, improve functionality, and enhance user experience. These providers may collect information such as device information, usage data, and interaction patterns.  

These third parties may use tracking technologies to collect information about you when you use the SipScout app. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based advertising or other targeted content.  

We do not sell or provide personally-identifiable information to third parties, such as external ad networks. However, we do not control these third parties’ tracking technologies or how they may be used. How We Use Your Information 

We use information that we collect about you or that you provide to us, including any personal information, to: 

  • Provide, maintain, and improve the SipScout App and its contents, and any other information, products or services that you request from us. 
  • Create and manage your account. 
  • Authenticate users through third-party sign-on providers. 
  • Show relevant nearby Venues, happy hours, events, and personalized recommendations. 
  • Store your preferences, saved Venues, and settings. 
  • Respond to your comments, questions, and support requests. 
  • Send administrative information, such as updates, security alerts, and changes to our policies. 
  • Send promotional communications (where permitted by law and subject to your preferences). 
  • Analyze usage patterns and trends to improve user experience and functionality. 
  • Detect, prevent, and address technical issues, fraud, misuse, and security threats. 
  • Comply with legal obligations and enforce our Terms of Service. 

The usage information we collect helps us to improve the SipScout App and to deliver a better and more personalized experience by enabling us to: 

  • Estimate our audience size and usage patterns. 
  • Improve search functionality and performance. 
  • Store information about your preferences, allowing us to customize the SipScout App according to your individual interests. 
  • Speed up your searches. 
  • Recognize you when you use the SipScout App. 

We use location information we collect to display nearby Venues, happy hours, and events; to provide location-based recommendations within the SipScout App; and to improve our search functionality and performance.  

We may also use your information to contact you about our own and third parties’ services that may be of interest to you. If you do not want us to use your information in this way, please adjust your user preferences in your account profile. We may use the information we collect to display advertisements within the SipScout App to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria. 

Disclosure of Your Information 

In order for us to provide our services to you, we may disclose aggregated information about our users, and information that does not identify any individual without restriction.  

In addition, we may disclose personal information that we collect or you provide: 

  • To contractors, service providers, and other third parties we use to support, operate, maintain, and improve the SipScout App and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.  
  • To third parties where we may share aggregated, anonymized analytics with Venues regarding user engagement with their listings. This information does not identify individual users. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.  
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by our Company about the SipScout App users is among the assets transferred. 
  • For any other purpose disclosed by us when you provide the information. 
  • With your consent. For any other purpose disclosed to you at the time you provide the information or with your explicit consent. 
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request. 
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our Company, our customers or others.  

Your Choices About Our Collection, Use, and Disclosure of Your Information 

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.  

  • Tracking Technologies. You may, when applicable and available within the SipScout App, choose whether or not to allow the SipScout App to collect certain information through other tracking technologies by using the SipScout App settings or system settings. If you disable or refuse such data collections or otherwise disable or block the use of other tracking technologies, some parts of the SipScout App may then be inaccessible or not function properly. 
  • Location Information. You can choose whether or not to allow the SipScout App to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the SipScout App may become inaccessible or not function properly. 
  • Promotion by the Company. If you do not want us to use your email address or phone number to promote our own or third parties’ products or services, you can always opt-out by logging into the SipScout App and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to cheers@sipscoutsocial.com.  
  • Targeted Advertising by the Company. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by adjusting your user advertising preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to cheers@sipscoutsocial.com. 
  • Disclosure of Your Information for Third-Party Advertising and Marketing. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt-out by logging into the SipScout App and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to cheers@sipscoutsocial.com.  

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website. 

Accessing and Correcting Your Personal Information 

You can review and change your personal information, or request deletion of your account and personal information, by logging into the SipScout App and visiting your account profile page. 

You may also send us an email at cheers@sipscoutsocial.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. 

Your State Privacy Rights

Under applicable Texas privacy laws, Texas residents may have the right to: 

  • Confirm whether we are processing their personal information; 
  • Access the personal information we hold about them; 
  • Correct inaccuracies in their personal information; 
  • Delete personal information provided by or obtained about them; 
  • Obtain a copy of their personal information in a portable and readily usable format; and 
  • Opt out of the processing of personal information for: 
  • Targeted advertising, 
  • The sale of personal data, or 
  • Profiling in furtherance of decisions that produce legal or similarly significant effects.

We will respond to verified consumer requests in accordance with applicable law. 

If we decline to take action regarding your request, you may have the right to appeal our decision by contacting us at the email address listed above with the subject line “Privacy Appeal.” 

Data Security 

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. These measures include, among other things, encryption of data in transit and at rest, regular security assessments and audits, access controls and authentication measures, and employee training on data protection. All information you provide to us is stored on our secure servers and will be encrypted.  

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the SipScout App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.  

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the SipScout App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide. 

Changes to Our Privacy Policy 

We may update this Policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page, and may notify you in-app or via other method, including email or SMS, of the existence of such changes. 

The date the Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address and phone number for you and for periodically visiting this Policy to check for any changes.
